participation agreement, waiver + release.

this is the agreement behind the pickup-day signup form. signing happens in that form — typing your full name + today's date counts as your signature (section 9). the full text:

the short version

your child gets free worldie shoes to play in and keep. we'll fit them at a short play day event with games, snacks, and drinks, then ask for your honest feedback a couple of times. you choose whether we can use photos of your child. you can leave the program, or ask us to delete your child's information, anytime by emailing community@worldiebrand.com. this summary is here to help; the numbered sections below are the agreement.

This Participation Agreement and Release (this “Agreement”) is between worldie and the parent or legal guardian signing below. It lets each child listed below (each, a “Participant”) take part in wear-testing and feedback activities in the worldie adventure club (the “Program”) during the Term, starting with the Initial Activity named above. It does not govern general club membership, which is free and optional. I confirm that I am the parent or legal guardian of each Participant and have authority to sign for them.

1. the program

For each activity a Participant joins, we will provide worldie footwear or other test items (the “Product”) at no cost. The Product is the Participant's to keep, whatever the feedback says. For the Initial Activity, we will fit the Product at the event, the Participant can join about an hour of games and play, and snacks and drinks may be provided. Afterward, the Participant wears the Product during normal play, and I will share honest feedback when worldie asks, expected around weeks two and six after the event. Every activity is opt-in, no purchase is ever required, sizes and colorways depend on availability, and events may be rescheduled or relocated (for example, for weather). I can withdraw a Participant at any time by emailing community@worldiebrand.com.

2. safety, risk, and release

The Product is athletic footwear or a related item made for kids' everyday play, and Program activities include the ordinary risks of any physical activity, including games and play at events, interactions with other attendees, and snacks and drinks that may be offered. I will stay present at events and supervise the Participant as I normally would; worldie does not provide childcare. I am responsible for deciding whether any food or drink offered is right for the Participant, and I will tell worldie about allergies in advance. I will check the fit of the Product before regular use, and I will stop use and tell worldie if the Product causes discomfort or seems damaged or defective; worldie will respond promptly to any concern I raise.

To the extent permitted by law, I release worldie and its affiliated entities, officers, directors, employees, volunteers, agents, sponsors, and partners (the “Released Parties”) from all claims arising from a Participant's participation in Program activities during the Term, except claims based on gross negligence or intentional misconduct. This release covers claims I do not know about when I sign, and I waive any law that would limit the release of unknown claims. I agree to work in good faith with worldie to resolve any concern that comes up.

3. feedback

I give worldie a worldwide, royalty-free license to use and act on the feedback, suggestions, survey responses, and testimonials that I or a Participant provide during the Term, including in product development, marketing, and investor materials. For feedback actually provided during the Term, this license is perpetual and irrevocable. worldie may credit feedback with my first name and city, or anonymize it, consistent with my choice in Section 4. The Product is the only compensation for feedback.

4. photos and videos (my choice)

Program activities may involve photos or video of a Participant, taken by worldie or shared by me. Please choose ONE option. Participation does not depend on saying yes.

YES. worldie and its affiliates may use each Participant's first name, photo, video, and likeness from Program activities during the Term in any media, including marketing, our website, and social media, without further approval or compensation. I can revoke this for future uses by emailing community@worldiebrand.com; materials already published or in production may continue to be used.
NO. worldie may not use a Participant's photo, video, or likeness in public-facing materials, and may use feedback only on an anonymized basis. I will let worldie staff know at event check-in so they can avoid featuring the Participant.

5. social posts

Posting is never required. If I choose to post about the Product, I will clearly disclose that worldie provided it for free (for example, “#gifted” or “worldie sent us these shoes to test”), consistent with the Federal Trade Commission's endorsement guides.

6. children's information

worldie collects only the Participant details listed above plus my contact and shipping information, uses them only to run the Program and communicate with me, and never sells them. I can ask worldie to delete Participant information at any time by emailing community@worldiebrand.com, and worldie will, except for records the law requires it to keep. Photos and video follow my choice in Section 4.

7. term and what survives

This Agreement covers Program activities during the Term and expires on its own at the end of it; any later wear-testing or feedback activity needs a fresh agreement. A few things survive because they look backward: the Section 2 release, for activities that happened during the Term; the Section 3 license, for feedback already provided; the Section 4 media license, if elected, for materials created or published during the Term, together with my revocation right; and my deletion rights under Section 6, for as long as worldie holds Participant information.

8. governing law

Delaware law governs this Agreement, without regard to conflicts of laws principles.

9. signing electronically

This Agreement may be signed and delivered electronically. Typing my name into a signature field or an online form worldie designates, and affirmatively indicating my agreement, counts as my signature. This is the entire agreement between worldie and me about the Program.

acknowledgement and signature

I HAVE READ THIS AGREEMENT, I UNDERSTAND THAT IT INCLUDES A RELEASE OF LIABILITY AND A MEDIA CONSENT CHOICE, AND I SIGN IT FREELY, INTENDING TO BIND MYSELF AND EACH PARTICIPANT.
